Terms and Conditions:
1- Client warrants that client is the registered legal owner of the vehicle being transported, or that Client has been duly authorized by the legal owners to enter into this Contract for transportation of the Vehicle.
2- Contracted carriers offer door-to-door transport services provided that the truck driver can physically access the pickup and delivery addresses. If access to the pickup or delivery location is restricted by narrow streets, low-hanging trees, or tight turns, the driver will request and client must meet the truck at a nearby large parking lot, such as a grocery store.
3- The client agrees not to engage any other broker or carrier during the duration of their shipping option. If a client is found to be working with another broker or carrier during this period, they will be subject to a non-refundable deposit fee.
4- Carriers are not licensed or insured to transport any personal or household goods. However, we acknowledge that clients may need to load some items into the vehicle. The carrier will not be held liable for any damage caused to the vehicle due to excessive or improper loading of personal items. Clients are only allowed to put personal items in the trunk, and the total weight should not exceed 100 lbs. Exceptions must be discussed and approved by EXPEDITE Auto Transport beforehand. Additional fees may be assessed for personal items of any weight. Any misrepresentation of the personal belongings will result in a change of price or driver can refuse to load an overly loaded vehicle.
5- The carrier and driver, jointly and separately, are authorized to operate and transport the client’s motor vehicle from its pickup location to the designated destination, subject to the terms and conditions of this agreement. The parties acknowledge that while the carrier will make every effort to confirm a driver for the estimated date, no guarantee of pickup or delivery date can be made. Delays may occur due to carrier schedules, dry routes, mechanical failure, inclement weather, acts of God, or other unforeseen circumstances beyond the control of the carrier and driver. EXPEDITE Auto Transport shall not be liable for any charges or liabilities incurred due to the delay of pickup or delivery, including, but not limited to, airline tickets or rental car fees. The client will be provided with the carrier’s schedule at the time of dispatch.
6- If the carrier is sent out, and the vehicle is not ready as indicated by the shipper or shipment is different from what was described, a dry run fee of $150.00 will be charged, and an additional $75.00 rescheduling fee will also be charged to send another truck on the new date or time. EXPEDITE Auto Transport must be notified if the shipper is unavailable for pick-up or delivery. The shipper must provide an alternate representative to take their place.
7- The Client shall be responsible for preparing the Vehicle for shipment. All loose parts, fragile or protruding accessories, low-hanging spoilers, antennas, etc., must be removed and/or properly secured. Any part of the Vehicle that falls off during transport is the Client’s responsibility, including damages caused to any other vehicles involved. Security systems should be disarmed and any keys or transmitters for said device must be provided to the transporter.
8- Trucking damage and vehicle theft claims fall within the responsibility of carriers only, with coverage from $100,000 up to $250,000 cargo insurance per load, and a minimum of 3/4 of a million dollars public liability and property damage. Any damage or theft incurred to a vehicle during transport is the direct responsibility of the contracted carrier and not of EXPEDITE Auto Transport. All carriers will be insured to cover damage caused by the driver or theft during transport. In case of damage, EXPEDITE Auto Transport will provide the client with complete insurance package details for the contracted carrier to file a claim. Clients are required to note and sign all claims at the time of delivery.
9- In the event that client cancels this contract for any reason whatsoever, Client shall pay EXPEDITE Auto Transport a minimum cancellation charge of $100.00 in addition to any other amounts due under this Contract. A “dry run” fee may be assessed in the event Client is unavailable or unwilling to provide the Vehicle for transportation as of the first date of availability as designated on the shipping form.
10- Any deposits made to EXPEDITE Auto Transport under this contract are non-refundable and non-creditable transactions. A 3.5% transaction charge will be applied on all credit card and PayPal payments.
11- EXPEDITE Auto Transport’s responsibility for the Vehicle commences when the bill of lading is issued and signed by the driver and terminates when the Vehicle is signed for at destination.
12- In the event that there are any unforeseen delays regarding delivery, federal regulations require that all outstanding freight charges be paid without deductions. The Client agrees to properly note any damage claimed at the time of the delivery of the Vehicle, and to pay the balance of the delivery charges in cash or certified funds. Damages not noted on the transportation agent’s bill of lading will not be honored (no exceptions). Any claim of damage caused by the contracted carrier must be made within 15 days of delivery in writing, specifying the damage claimed. The transportation agent actually transporting the Vehicle shall be liable for any and all damage claims arising from the transport. The Client agrees to file all claims with such transportation agent as identified on the transportation agent’s bill of lading/delivery receipt and to bring any legal action for damages against such transportation agent only. The Client agrees to release and hold harmless EXPEDITE Auto Transport from any such claims.
13- The Client shall, in its absence, designate someone to act as the Client’s agent at the points of pick up and/or delivery.
14- Due to the ever-changing and shifting auto transportation landscape, carrier availability and pricing are subject to change. Client understands and agrees that there is no guarantee of exact final price as pricing for shipment varies on every load/daily basis. If this happens, EXPEDITE Auto Transport will make all possible efforts to locate a secondary option for the client.
15- Placed orders must be canceled by calling the offices of EXPEDITE Auto Transport. Cancellations must be made no less than 24 hours prior to the pick-up date. Cancellations of placed orders are subject to a non-refundable deposit fee, and a dry run fee may be charged if not canceled by the given deadline. The shipper shall be responsible for any fees incurred as a result of a cancellation, and EXPEDITE Auto Transport shall not be held liable for any damages arising from such cancellation.
16- EXPEDITE Auto Transport warrants and Client acknowledges that EXPEDITE Auto Transport is licensed by the Federal Motor Carrier Safety Administration.
17- After the Client makes the Vehicle available to EXPEDITE Auto Transport for transport, EXPEDITE Auto Transport shall use its best efforts to pickup/deliver the Vehicle in an expedient manner. However, EXPEDITE Auto Transport does not guarantee the date or time of pickup/delivery.
18- This Contract will be construed in accordance with the laws of Wyoming, without application of its choice-of-law principles.
19- This agreement shall be governed by and construed in accordance with the laws of the State of Wyoming. The parties further agree that any legal action arising out of this agreement must be filed in a court of jurisdiction, and EXPEDITE Auto Transport’s liability is limited to the amount of EXPEDITE Auto Transport’s broker fee only. The shipper hereby submits to the jurisdiction of such courts and waives any right to jurisdiction in any other location. The shipper hereby agrees to the transport terms provided by EXPEDITE Auto Transport.
20- The shipper authorizes a small down payment to be paid to EXPEDITE Auto Transport via Credit/Debit/Zelle/PayPal/Venmo/CashApp by phone or mail, and that down payment is non-refundable and non-creditable in any case. The shipper further understands that any remaining balance is due on delivery and must be paid in full via cash, cashier’s check, or money order to the authorized transporter.
